These Terms and Conditions (“Terms”) govern the use of the Myhitch platform by brand owners, product owners, merchants,
and sellers (“Brand Owner”, “You”, “Your”). By creating an account or using the Myhitch platform, you agree to be bound
by these Terms.
1. About Myhitch
Myhitch Australia (“Myhitch”, “We”, “Us”, “Our”) provides a digital platform that enables brand owners and product owners
to list, manage, promote, and sell their products and services. Myhitch acts only as a platform and support provider and
does not own, manufacture, supply, store, or deliver products unless explicitly agreed in writing.
2. Eligibility & Account Registration
2.1 You must be at least 18 years of age and legally capable of entering into a binding agreement.
2.2 You must provide accurate, current, and complete information when creating your account.
2.3 You are responsible for:
Maintaining the confidentiality of your login details
All activities conducted under your account
2.4 Myhitch reserves the right to suspend or terminate accounts that provide false, misleading, or incomplete information.
3. Role & Responsibilities of Brand Owners / Product Owners
By using the Myhitch platform, you acknowledge and agree that full responsibility for your products and services remains with you,
including but not limited to:
3.1 Product Responsibility
You are solely responsible for:
Product quality, safety, and compliance
Accuracy of product descriptions, pricing, images, and claims
Compliance with all applicable Australian laws, regulations, and industry standards
Product warranties, guarantees, and representations
3.2 Legal & Regulatory Compliance
You must ensure your products comply with:
Australian Consumer Law (ACL)
Product safety standards
Labelling, advertising, and marketing regulations
Any industry-specific licensing or certification requirements
3.3 Orders, Fulfilment & Delivery
Unless otherwise agreed in writing:
You are responsible for order fulfilment, shipping, delivery, and logistics
You are responsible for handling delays, damages, lost items, or delivery disputes
3.4 Returns, Refunds & Customer Support
You are responsible for:
Managing returns, refunds, exchanges, and complaints
Providing customer support related to your products
Complying with Australian Consumer Law refund and warranty obligations
4. Myhitch’s Role & Limitations
4.1 Myhitch provides:
A digital platform for listing and managing products
Technical, operational, and platform-related support
Optional marketing, analytics, or promotional tools (where applicable)
4.2 Myhitch does not:
Verify or guarantee product quality, safety, or legality
Act as the seller, manufacturer, or distributor of your products
Assume responsibility for customer disputes related to products
4.3 No guarantees
Myhitch makes no guarantees regarding:
Sales volume or revenue
Platform availability (though reasonable efforts are made to maintain uptime)
5. Fees & Payments
5.1 Myhitch may charge subscription fees, transaction fees, commission, or service fees (as disclosed separately or agreed in writing).
5.2 You are responsible for all applicable taxes (including GST) and accurate pricing and tax configuration of your products.
5.3 Fees are non-refundable unless required by law or expressly stated otherwise.
6. Intellectual Property
6.1 You retain ownership of all intellectual property related to your brand and products.
6.2 By using Myhitch, you grant Myhitch a non-exclusive, royalty-free license to use your brand name, logos, and product content solely for platform operation, marketing, and promotional purposes.
6.3 You warrant that you own or have the right to use all content you upload.
7. Prohibited Conduct
List illegal, unsafe, or prohibited products
Provide false, misleading, or deceptive information
Infringe intellectual property rights
Use the platform for fraudulent or unlawful activities
Myhitch may remove content or suspend accounts at its discretion.
8. Indemnity
You agree to indemnify and hold harmless Myhitch, its directors, employees, and partners from any claims, losses, damages,
liabilities, or expenses arising from:
Your products or services
Breach of these Terms
Violation of laws or third-party rights
Customer disputes related to your products
9. Limitation of Liability
To the maximum extent permitted by law:
Myhitch is not liable for indirect, incidental, or consequential damages
Myhitch’s liability is limited to the fees paid by you to Myhitch in the preceding 12 months
Nothing in these Terms excludes rights under Australian Consumer Law that cannot be excluded.
10. Suspension & Termination
10.1 Myhitch may suspend or terminate your account if you breach these Terms, engage in unlawful or harmful activity, or damage the reputation or operation of the platform.
10.2 Upon termination, your listings may be removed and outstanding fees remain payable.
11. Privacy & Data
Use of the platform is subject to the Myhitch Privacy Policy. You are responsible for complying with privacy laws in relation
to customer data you access.
12. Amendments
Myhitch may update these Terms from time to time. Continued use of the platform constitutes acceptance of updated Terms.
13. Governing Law
These Terms are governed by the laws of Australia, and the courts of the relevant Australian state or territory shall have
exclusive jurisdiction.
